General provisions
The website kernex.md is owned and operated by KERNEXIT S.R.L. (IDNO 1026023040248), Chișinău, Republic of Moldova — hereinafter “KERNEX”, “we”. The same operator runs our product platforms: datero.md, kxestate.md and klaro.md.
These Terms & Conditions apply to KERNEX services ordered through kernex.md, by e-mail or under a contract, and to the BZZZ! game for iPhone. Datero.md, KX Estate and Klaro have their own terms, published on those products' sites, which apply to them instead of these. By ordering a service or signing a contract, the customer confirms that they have read and accept these terms.
The relationship between KERNEX and the customer is governed by the law of the Republic of Moldova: the Civil Code, Law no. 284/2004 on electronic commerce, Law no. 105/2003 on consumer protection (for customers who are natural persons) and Law no. 195/2024 on personal data protection.
We may update these terms. The current version and its effective date are published on this page. Work stages already paid remain under the terms in force on the payment date.
What we sell
Through kernex.md we sell two things:
- KERNEX IT and KERNEX Design services — development of websites, apps and SaaS, AI integrations, technical SEO and GEO, visual identity and UI/UX. The scope, stages, timeline and price of each project are set in the commercial offer and the contract; the services are described on the Services pages.
- Paid decks in the BZZZ! game for iPhone — in-app purchases through the App Store. The price is shown in the App Store in your country's currency.
Prices for services are individual and are communicated in the offer before any payment.
Personal data protection
We process personal data in accordance with Law no. 195/2024 on personal data protection. Controller: KERNEXIT S.R.L.
To perform the contract we collect only what is necessary: name, e-mail, phone, company name and billing details, the order contents and the payment history. The legal basis is the performance of the contract and our legal obligations (accounting and tax records).
The BZZZ! game collects no personal data. Its purchases are processed by Apple: card details, name and Apple ID never reach us.
Data is not sold or shared with third parties, except for the processors needed to perform the contract (the transactional e-mail service, hosting) and the cases required by law. You have the right of access, rectification, erasure, restriction, portability and objection, and the right to lodge a complaint with the CNPDCP. Send requests to hello@kernex.md.

Analytics cookies (Google Analytics 4) are set only after you press “Accept” in the consent banner; the choice can be withdrawn at any time.

Ordering and payment
A service is ordered through the contact form or by e-mail. Once the scope is agreed you receive the commercial offer, the contract and the invoice.
Payment options:
- Services — by bank transfer against the invoice issued by KERNEXIT S.R.L., using the bank details stated in the document. Transfer fees are borne by the payer.
- BZZZ! purchases — through the App Store, with the payment method linked to your Apple ID. The payment is processed by Apple.
If a price is expressed in a currency other than MDL, the amount payable in lei is calculated at the official rate of the National Bank of Moldova on the day the invoice is issued, unless the offer states otherwise.
Delivery terms
Our services and purchases are digital; there is no physical delivery and the delivery cost is zero.
- Services: deliverables are handed over electronically — files, access to repositories, accounts and systems — in stages, following the schedule in the contract. Each stage is closed with an acceptance act signed by both parties (including by electronic signature).
- BZZZ!: a purchased deck unlocks in the app right after Apple confirms the purchase. On another iPhone or after reinstalling, the “Restore purchases” button brings it back.
If a deadline cannot be met for objective reasons, we inform the customer before it expires and agree on a new one. Support: hello@kernex.md, we reply within 24 working hours.
Refund policy
The right of return applies as follows:
- Custom services — the advance is refunded in full if the work has not started; after the work starts, the difference between the amount paid and the value of the accepted stages is refunded, as set in the contract.
- Invoice payments made in error (duplicate or wrong amount) — full refund.
- BZZZ! purchases — refunds are handled by Apple under Apple's rules at reportaproblem.apple.com. We have no access to App Store payments, so we cannot refund a purchase directly.
Refunds for services are made to the bank account the payment came from, within 10 working days of approving the request. Send requests to hello@kernex.md or +373 68 508 886 with the invoice number and the reason; we reply within 3 working days.
Customers who are natural persons additionally have the rights provided by Law no. 105/2003 on consumer protection.
BZZZ! support
Liability, governing law and disputes
The BZZZ! game is provided “as is”. Warranties for services, if any, are set in the contract. To the extent permitted by law, our total liability towards a customer is limited to the amount they paid in the last 12 months.
Disputes are first resolved amicably; failing agreement, the courts of Chișinău municipality, Republic of Moldova, have jurisdiction.
